To the Constable, or any other suitable person ofthe Town ofChelmsford: Greeting: In the name ofthe Commonwealth aforesaid, you are hereby requested to notify and warn the Town Meeting Representatives ofsaid Chelmsford to meet in the Senior Center, Groton Road, North Chelmsford on Monday, the twenty-sixth ofFebruary, at 7:30 p.m. in the evening then and there to act upon the following articles, VIZ: ARTICLE 1. To see ifthe Town will vote to accept Sections 3 to 7, inclusive, ofChapter 44B ofthe General Laws, otherwise known as the Massachusetts Community Preservation Act, by approving a surcharge on real property for the purposes permitted by said Act, including the acquisition, creation and preservation ofopen space, the acquisition and preservation ofhistoric resources, the acquisition, creation and preservation ofland for recreational use, the creation, preservation and support of community housing, and the rehabilitation and restoration ofsuch open space, historic resources, land for recreational use and community housing that is acquired or created as provided under said Act; to determine the amount ofsuch surcharge on real property as a percentage ofthe annual real estate tax levy against real property; to determine whether the Town will accept any ofthe exemptions from such surcharge permitted under Section 3(e) ofsaid Act; or act in relation thereto. SUBMITTED BY: Board ofSelectmen ARTICLE 2. To see ifthe Town will vote, pursuant to the provisions ofMGL c. 44B, §5, to amend the Chelmsford Code, Chapter 19, to adopt a new general by-law creating a Community Preservation Committee to read as follows: Chapter 19 Community Preservation Committee § 19-1. Establishment; appointment ofmembers; membership; terms ofoffice. There is hereby established a Community Preservation Committee, consisting ofnine (9) voting members, pursuant to the provisions ofMGL, c. 44B, §5. The composition ofthe Committee, the appointing authority and the terms ofoffice for the Committee members shall be as follows A. Membership. One member ofthe Conservation Commission as designated by the Commission; (1) (2) One member ofthe Historical Commission as designated by the Commission; (3) One member ofthe Planning Board as designated by the Board; (4) The Public Works Director, whose responsibilities include the duties ofthe Board MGL ofPark Commissioners established under c. 45, §2, or his designee; (5) One member ofthe Housing Authority as designated by the Authority; (6) One member ofthe Finance Committee as designated by the Committee; (7) The Community Development Director; (8) The Town Manager, or the Town Manager’s designee; and (9) One member ofthe Board ofSelectmen, as designated by the Board ofSelectmen. B. Each member ofthe Committee shall serve for a term ofthree years or until the person no longer serves in the position or on the board or committee as set forth above, whichever is earlier. C. Should any ofthe officers and commissions, boards or committees listed in this section no longer be in existence for whatever reason, the Town Manager shall appoint a suitable person to serve in his or her place. D. Any member ofthe Committee may be removed for cause by his or her respective appointing authority after hearing. § 19-2. Duties. A. The Community Preservation Committee shall study the needs, possibilities and resources ofthe town regarding community preservation. The Committee shall consult with existing municipal boards, including the Conservation Commission, the Historical Commission, the Planning Board, the Department ofPublic Works, and the Housing Authority, or persons acting in those capacities or performing like duties, in conducting such studies. As part ofits study, the Committee shall hold one annual public informational hearing, or more, at its discretion, on the needs, possibilities and resources ofthe town regarding community preservation possibilities and resources, notice of which shall be posted publicly and published for each oftwo weeks preceding a hearing in a newspaper ofgeneral circulation in the town.
