In the case ofterNeiizen v. Korn (1995), the plaintiff, KobeterNeuzen, and her husband were unable to have a child duetothe husband's infertility. The plaintiffwent to the clinicoperated bythe defendant. Dr. Korn, tobe artificially inseminated. Unfortunately, she became infected with HIV (thevirus that causes the disease AIDS) duetothis insemination and sued Dr. Korn and his clinic for negligence. (She also sued under contract law, but this needn't concernyou here). The casewent to the Supreme Court of Canada in 1995. a. When the plaintiffwas attending Dr. Korn's clinic (years before the case ended up in the Supreme Court), little was known ofthe risks that mightbe involvedbecause the procedure was new. Doyou thinkthat this fact should have reduced Dr. Korn's liability as a doctor and a professional? Give clear reasons foryour answer. © b. What precautions doyou think shouldbe used todayto protect people like Ms. ter Neuzen?
