Owens Corning {india} Limited, Mumoai and OCV Reinforement manufacturing Livited, Thimmapur. Hyderabad The application has been supported by Mis. Goa Glass Fibres Limited. It is noted that Owens Coming (India) Limited and OCV Reinforement Manufacturing Limted are rolated to each other and have related entities in a number of countries outside India having manufacturing faclites for production of the product under consideration ard ther types of glass fibres. It is noted that such related company in China PR has exported very small volume (‘ess than 0.05% of praduetion: by the domestic industry of the product under consideration during the investigation period. The petitioners ‘have claimed that these subjact goods heve been cleared after the investigation Period On the basis of information available on record, and considering that the volume of exports made by the related company are very insignificant, the Authority determines that the petitioner companies are eliaible fo file the present pelion within the meaning of Rule 2(5) and Rule § of the Rules There is no other producer of product under consideration n India. It is noted that (a) production of the applicant constitutes @ major prapertian in Indian production; (b) domestic producers express'y supporting the application acceunt for more than 50 percent of production of the like product produced by the domestic industry; and (c) the application has been made by ar on bahalt of the domestic industry. The ‘Authority after examining the information on record, and having considered the fact of exports by patitioners' related entities n the light of scope af Rule 2:b}. determines that the applicant consttutes domestic Industry within the: meaning of the Rule 2 ane the application satisfies the criter'a of standing in terms of Rule & of the Rules supra 4 COLINTRY INVOLVED The country involved in the present investigation is China PR. 5. NORMAL VALUE: the applicant have claimed that China PR is anon market economy and proposed that Korea RP should be considered as appropriate surrogate country for China PR. The applicants have furrisned infermation rolating to prices in demestic marke: in Korea RP and determined rormat value in China a8 per prives prevailing in Korea RP. The Authority hereby invites comments from all interested parties in accordance to para 7 of Annexure | about appropriateness af Korea RP as surrogate country far China PR. Separate normal value is determined for each type of the product and average normal value Ie also determined for the product concern as a whole, Thete is sufficient prima facie evidence with tegard lo nornal value claimed by the petitioners. Lamu) 6. EXPORT PRICE Export price of the subject gonds fiom the subject councries has been determined by considering transaction-wise import data colected frarn Secondary Sources. Adjustments hhave been made on account of acean freight, marine insurance, commission, and gort expenses etc. in the exporting country to arrive at ex-factory export price. There +s sufficient prima facie evidence with regaré to expert price claimed by the pewtioners 7. DUMPING MARGIN Normal value and export price have beon compared at ex-factary level, which shaws significant dumping margin in respect of the subject country. There is sufficient evidence that the normal value af the subject aces in China is significantly higher than the ex: factory export price indicating, prima facie, that the subject goads are belng Jumped by exporters from China into the Indian nar 8. INJURY AND CAUSAL LINK ‘ ‘The applicant has furnished information en various parameters relating to materiat injury Analysis of the information stows that imports from subject countey have inereased in the period of investigating in absolute term 3s also in relation to preluctlor and consumption ‘in india. Various economic parameters ike the toss in market share, significant destine ia the profitability of the damestic industry, significant dteriaration 1m return on investment and cash profit, prima facie, indicate collectively and cumulatively that the domestic industry have suttereé material injury on account of dumped imports of subject goods from China PR, 9. INITIATION OF ANTI DUMPING BHYESTIGATIONS “The Designated authority, in view of the foregoing paragraphs, finds that sufficient prima facie evience of dumping of the subject goods fram the China PR, injury to the domestic industry and causal link between the dumping and injury exist, The Authority hereby Initlates an investigation iato the alleged dumping, and consequent injury to the domestic industry in terms of the Rules § of the said Rules, to dotenmine the existence, degres and effect of any alleged dumping and ta -ecommend the amount of antidumping duty wich, if levied, would be adequate ta remove the injury to the damestic industry. 10. PERIOD OF INVESHIGATION (PON) ‘The Period of Investigation for the purnose of the present investigation is Aprit 2008 - Sept, 2009 (18 months). The injury investigation peried will, however, cover the period 2005-06, 2006-07, 2007-08 and the POI, 11.
