IN THE HOUSE OF REPRESENTATIVES October21,1997 Mr.Starkintroducedthefollowingbill;whichwasreferredtotheCommittee onCommerce, andin additiontotheCommitteeonWaysandMeans, foraperiodtobesubsequentlydeterminedbytheSpeaker,ineachcase forconsiderationofsuchprovisionsasfallwithinthejurisdictionofthe committeeconcerned A BILL To amend title XVHI ofthe Social SecurityAct to provide forpaymentfordrugsfurnishedincidenttohospitalout- patient department services under the prospective pay- ment systemforhospital outpatientdepartmentservices. 1 BeitenactedhytheSenateandHouseofRepresenta- 2 tivesoftheUnitedStatesofAmericainCongressassembled, — 2 1 SECTION1.PAYMENTFORCERTAINDRUGSUNDERMEDI- 2 CARE PROSPECTIVE PAYMENT SYSTEM FOR 3 HOSPITALOUTPATIENTDEPARTMENTSERV- 4 ICES. 5 Section 1833(t)(l) of the Social Security Act (42 6 U.S.C. 13951(t)(l)), as added by section 4523(a) ofthe 7 Balanced BudgetAct of 1997, is amended by adding at 8 theendthefollowing: — 9 "(C) Treatmentofcertaindrugs. — 10 "(i) In general. In carrying out 11 subparagraph (B)(i), any drugthat is ad- 12 ministeredincidenttoahospitaloutpatient 13 service(otherthanadrugthatisfamished 14 to the individual for use outside the hos- 15 pital) shallbetreatedunderthistitle asa 16 drugthat cannot be seLf-administered and 17 designated as covered OPD services. Pay- 18 raent of the medicare OPD fee schedule 19 amount under this subsection shall be 20 treated as payment in full for such drug. — 21 "(ii) Budget neutrality.
